Class H: Negotiations
H-1(op) The JCTA Board of Directors shall determine the method for contract ratification from among the following procedures:
  1. Voting may be conducted by Professional Representatives in their own local schools according to a timeline determined by the Credentials and Elections Committee, unless the location is otherwise directed by the Representative Council. All such voting shall be by secret ballot. Tabulation of ballots shall be done by the Credentials and Elections Committee.
  2. Voting may be done by postcard ballot according to a timeline determined by the Credentials and Elections Committee. Tabulation of postcard ballots shall be done by the Credentials and Elections Committee at the conclusion of the ballot period. All contract mailings for contract ratification shall be mailed first class.
  3. Voting may take place at a general membership meeting. A secret ballot shall be provided. An optional voting area outside the mass meeting area shall be provided. Tabulation of ballots shall be done by the Credentials and Elections Committee. (C) (11/02) (B)

H-2(op) Only those Association members in the JCTA bargaining unit as defined by the JCTA/JCBE contract shall be allowed to vote on the ratification of the contract. (C) (11/02) (B)

H-3(op) If all contract and salary negotiations are not complete and ratified by five (5) days prior to the expiration date of the contract, a Representative Council meeting shall be held on that day for the purpose of adopting a recommendation to be presented to the membership at a general membership meeting, on or before the expiration date of the contract. (C)

H-4(op) The JCTA Bargaining Team shall be selected according to the following process:

  1. Applicants for the JCTA Bargaining Team shall be solicited through ACTION during the months of February and March. Those interested shall be asked to make a formal letter of application to the President of JCTA by no later than 5:00 p.m. April 1. The letter of application must include the following information:
    • The reason they are interested in serving on the JCTA Bargaining Team and why they should be selected for the team
    • Relevant association experience, including any bargaining experience
    • An overview of their teaching experience (for example, grade level and subject area)
    • Any special abilities or attributes they would bring to the team (for example, computer skills)
  2. Each applicant shall be given careful consideration.
  3. After consulting with the Executive Director, the President shall select those to serve on the Bargaining Team and inform the JCTA Board.
  4. The Executive Director shall train the Bargaining Team selected by the President. (2/96; 11/02) (B)
